Subject: Revised table for fixation of Pay as on 01.01.2007 in respect of Non-executives of BSNL.

Orders have been issued for allowing the benefit of merger of 50% DA effectively amounting to 78.2% as on 1.1.2007 for the purpose of fitment in respect of Non-executive employees of BSNL w.e.f. 10.6.2013, vide this Office order No. 1-16/2010-PAT(BSNL) dated 10.6.2013.

2. The revised tables for fixation of Pay as on 01.01.2007 in respect of Non-Executives of BSNL, are enclosed as Annexure for your information & further necessary action.

3. Errors & omissions are subject to rectifications and correction. Over payments  made, if any, shall be recovered as per rules.

Approval of the Management Committee of the Board is, hereby, conveyed for grant Child Care Leave to women employees of BSNL (absorbed/directly recruited/deputationists / deemed deputationists) as per the provisions of DOP&T OM No.13018/2/2008-EStt.(L) dated 11.09.2008 and subsequent clarifications issued by DOP&T.

2. These orders shall take effect from the date of issue.

Let paralysed officer return to work, tribunal tells BSNL

CHENNAI: The Central Administrative Tribunal on Monday came to the rescue of a BSNL junior technical officer (JTO) left partially paralysed by a stroke, directing the principal chief engineer of BSNL, Tamil Nadu zone, to allow him to report for duty in his post. The tribunal said the telecom company would have to accept the decision of the medical board and endorse the leave application of the JTO, M Manoharan.

The judicial member of the tribunal, G Shanthappa, said Manoharan had established that he should be granted relief and quashed a September 23, 2011 order that refused to allow the petitioner to rejoin as JTO . Manoharan suffered a massive stroke on June 1, 2002 that paralysed his arms and legs. He was not able to speak and was under continuous treatment for two years.

The respondents in the case included the executive engineer (civil), the superintending engineer and sub-division engineer (civil) of BSNL in Ambattur. "A competent medical authority examined the applicant and stated that the applicant suffered medical disability during the course of employment. The stand taken by the respondents is rejected," Justice Shanthappa said.

Manoharan told the tribunal that he applied for leave after the stroke and returned to duty on January 12, 2004. However, the chief engineer of Chennai Telephones, KK Nagar, the fourth respondent, directed the petitioner to appear before the medical board and obtain its opinion whether his fitness allowed him to perform his duty as JTO.

As advised by the board, he proceeded on 'commuter leave' for 90 days from September 13, 2010 and underwent various treatments including physiotherapy. But his seniors did not permit him to rejoin duty. They informed him that the regional medical board of Government General Hospital had on December 10, 2010 declared that he was medically unfit to perform his duties as JTO.

"The respondents did not accept the medical report of the applicant and did now allow him to rejoin duty," said the tribunal's administrative member, R Satapathy. "The stand of the respondents is not correct. It is illegal and violates of principles of natural justice."

Citing the Supreme Court's 2008 order in Bhagwan Dass vs Punjab Electricity Board, Justice Shanthappa said Manoharan had submitted documents to show that his medical disability had occurred while in service, and this was confirmed by Government General Hospital, so the respondents could not refuse to reinstate him.

Sub:- Revision of time period for permanent closure of telephone connection after disconnection due non payment - regarding
Ref:- Corporate office letter No.:-2-2/2011-BSNL/TR(Pt.) dated 09th Dec.-11

Kind reference is invited to this office letter of even No. dated 09-12-2011 referred to above prescribing instructions regarding extension of time limit for permanent closure of telephones disconnected due to non-payment from 90 days to 180 days.
In this regard, most of the Circles on the basis of certain valuable inputs have requested for reversal of the said instructions. Accordingly, the matter has been re-examined and based on the feedback / suggestions received from Circles, It has been decided to reduce the time period for closure of telephones, disconnected due to non-payment of dues to 90 days. The resources like cable pairs, ports and numbers getting spared through permanent closure of such telephones can be allotted to the new customers.

The above instructions will he applicable to those fixed line connections whose outgoing calls are barred w.e.f. 1st November 2012. As regards all other customers whose outgoing calls are barred prior to this date (i.e., upto 31-10-2012), the period for permanent closure will remain 180 days after date of disconnection due to non-payment.

All out efforts should, however, be made by the units to persuade the customers during the period of 90 days from DNP date, to not only make the payment of outstanding dues but also to rejoin BSNL and start reusing the service. In this connection, instructions regarding holding of exit interviews of subscriber leaving landline and broadband service of BSNL, issued vide this office letter No.43-3/2011/NWO-l-CFA dated 17th August, 2012, may also be followed meticulously.

Apart from action points mentioned above, following action may also be taken:
1. Efforts should be made to collect the mobile number and email address of landline customers. A drive should he carried out in all SSAs within one month to call/visit the customer premises to get the required data. After collection of the said data. SMS and Email reminder should be sent to customers who do not make payment of bill within 3 days of the due date for payment of the bill.

2. Besides reminders through Automatic Payment Reminder System (APRS) as per prescribed procedure, manual telephonic reminder may be given by BSNL staff under AO (TR) to all the customers who have not deposited outstanding dues within 10 days after due date of payment. For this purpose 2 to 4 Sr.TOAs need to be posted under AO (TR).

3. If the outstanding dues are not paid even after giving telephonic reminder, one staff member TRI from TR section along with line man of the concerned section should visit the customer premises jointly and pursue the customer for making payment of outstanding dues.

4. In case the outstanding dues are not recovered or subscriber is not cooperating, poster of non payment giving details of the dues may be considered to be posted in front of the House of the customer.

5. All these steps shall be completed during the period from the due date of payment of bill upto 90 days from the date of disconnection of telephone due to non-payment. Thereafter, in case of non-receipt of payment, the telephone be closed permanently.

6. After this, the defaulting customer may be served legal notice and necessary action prescribed under the existing guidelines may be taken to recover the dues.

This issues with the approval of Director (CFA).

Sub: Policy for allotment of staff quarters to retired employee -(Amendment)

The policy for allotment of vacant quarters in BSNL to retired BSNL/DOT Employees for their use was issued vides dated 30.12.2011.

Management Committee has approved to amend the existing policy and allow CGMs to allot the vacant staff quarters to the retired BSNL/DOT employees with following additional option to the existing policy for utilization of vacant staff quarters in BSNL issued vide No.482-16/2007-BG (Staff Qrs. ) dated 30.12.2011.

The vacant quarters can be leased out to retired employees for a period of 11 months subject to the condition that the lease deed is registered at the cost of the lessee and the lessee pays four months’ rent advance as security deposit. This will be an additional option for retired employees in addition to existing conditions of allotment. Other conditions of the existing policy shall remain same.”

Sub: House Rent Allowance (HRA) as per 6th CPC on Government Pattern.
Sir,
I am directed to invite your kind attention to this office letter of even no. dated 15.04.2010 on the subject cited above and to say that information is still awaited from meet of the Circles despite a series of reminders dated 01.06.2010, 29.07.2010, 22.06.2011, 22.07.2011 and 09.01.2012.
2. The information received from some circles has not been found in order. it is seen that HRA is, continuously being paid to BSNL employees as per rates admissible under Govt. rules prior to 2nd PRC or erroneously as per Govt. classification (i.e. X. Y & Z) prescribed under 6th CPC. It is informed that rates of HRA in respect of BSNL employees (absorbed and directly recruited) w.e.f. 27.02.2009 is on the basis of "Cities with Population" as classified under DPE guidelines communicated vide Para- 7 of this office order No.1-50/2008-PAT(BSNL) dated 05.03.2009 and Para-5 of office order No. 1-16/2010-PAT(BSNL) dated 07.05 2010.
3. It is further observed that unabsorbed employees working in BSNL have also been included for the purpose of working out financial implication by some units which is not in order. The un-absorbed employees are already paid HRA as per 6th CPC recommendation w. e.f. 01.09.2008. The financial implications for admissibility of HRA to BSNL absorbed and directly recruited employees as per classification prescribed under Govt. Rules after 6th CPC may be worked out on account of absorbed / directly recruited employees only.
4. The proposal for grant of HRA as per classification as available to Govt. employees under 6th CPC to BSNL absorbed / directly recruited employees which is under consideration with DOT, is getting delayed due to want of correct information.
5. The names of circles from where the information is still awaited or received information is not in order are even at Annexixe. In this regard information received from NE Circle which has been found in order is enclosed for your ready reference, It Is, therefore, requested that keeping in view of the observations as mentioned as Para (2) & (3) above, requisite information may please be furnished to this office within a week time from the date of issuance of this letter.
