Subject: Promotion of Section Officers of CSS to Grade-I (Under Secretary) of CSS on ad-hoc basis — regarding.
The undersigned is directed to refer to this Department’s O.M. of even number dated 30.06.2011 vide which vigilance status and APARs upto the period 2009-10 of Section Officers officers upto 2003 Select List was sought for consideration of adhoc promotion to the grade of US. The documents sought were to have been sent to this Department by 8.7.2011. The Screening Committee for assessing the suitability of officers for adhoc promotion commenced their assessment on 19th July 2011. The APARs and vigilance status received upto that date have been taken into account for assessment of officers. The Screening Committee assessed the candidature of 273 eligible Section Officers of the CSS in terms of extant guidelines/instructions for ad-hoc promotions. Officers as mentioned in the Annexure could not be assessed by the Screening Committee for want of APARS and or non-receipt of vigilance clearance etc.
2. The Ministries/Departments concerned are requested to send the missing APARs and also the vigilance clearance with reference to this Department’s O.M. No.22011/4/91-Estt.(A) dated 14.09.1992 and O.M. NO.22012/1/99-Estt(D) dated 25.10.2004, at the earliest. Brief details about the officers, who are not clear from vigilance angle, may also be given including relevant dates. All these officers can be assessed by the Screening Committee in the next round of adhoc promotion only on receipt of complete documents. Therefore, the requisite ACRs/vigilance clearance etc. in respect of 67 Section Officers as indicated in the Annexure may be sent to CS Division at the earliest.
3. It is also requested that APARS and vigilance status in respect of Section Officers upto CSL No.7314 in General category and CSL No.8052 in SC/ST category, if not sent to this Department as per O.M. of even number dated 30.06.2011, may also be made available at the earliest for consideration during the next round of ad-hoc promotion.

Subject: Disbursement of pension to the Central Government Pensioners in the State of Kerala for the month of August, 2010 on account of ONAM festival.
In continuation of this Office O.M. of even no. dated 5.8.2010 for disbursement of salary/wages of all Central Government employees in the State of Kerala for the month of August. 2010 on 20th August, 2010 on account of ONAM festival, the Government have decided that the pension of all Central Government pensioners in the State of Kerala for the month of August, 2010 may also be disbursed by the Banks/PAOs of Civil Ministries / Departments including Defence, Posts and Telecommunications on 20th August, 2010.
2. The pension so disbursed are to be treated as advance payments and will be subject to recovery, if any, in the subsequent payments from September.
3. Reserve Bank of India is requested to bring these instructions to the notice of the pension paying branches of all Banks located in the State of Kerala for necessary action immediately.

India has 24 Lakh New Pension System beneficiaries
The government on Tuesday said the number of beneficiaries under New Pension System (NPS) stood at over 24 lakh, of which about one-third comprised the central government employees.
As on March 31, 2011, the total assets managed by the pension fund managers amounted to Rs. 8,58crore.
"The number of beneficiaries under New Pension System as on August 11, 2011, is 24,14,188," Minister of State for Finance NamoNarainMeena said in a written reply to the RajyaSabha.
He said of the total subscribers, over 7.92 lakh were central government employees, while 9,042 were from private sector companies and 45,000 from the unorganised sector.
Besides, there were 41,826 employees from Central autonomous bodies and over 7.84 lakh from state governments.
On July 1, a committee of the pension fund regulator PFRDA had suggested an overhaul of the sector by lowering fund management charges and incentivising distributors to reach out to unorganised sector.
The Pension Fund Regulatory and Development Authority (PFRDA) had set up the G N Bajpai committee in August 2010 to suggest measures to fast track and popularise retirement scheme for individuals, including those in the informal sector under NPS.
"The report recommends that PFRDA should be financially autonomous, NPS should be made a part of the national financial inclusion agenda and the government should extend the Swavalamban incentive of Rs 1,000 every year for a longer period," Meena added.
At present, seven fund houses -- LIC Pension Fund, SBI Pension Funds, UTI Retirement Solutions, IDFC Pension Fund Management Company, ICICI Prudential Pension Fund Management, Kotak Mahindra Pension Fund and Reliance Capital Pensions Fund -- manage investment corpus of investors.
As on March 31, 2011, the total assets managed by the pension fund managers amounted to Rs. 8,58crore.

Stringent punishment and fine for publishing or transmission of pornography

Objectionable Content on Websites : - Every infrastructure/service may be used for hosting variety of applications and content of any nature. The web infrastructure does not distinguish the nature of content. The technology is therefore, used for purposes which may be liked by one section of society and not liked by other sections of society. Several groups have hosted websites with obscene/objectionable content on internet for variety of purposes. Such sites can be accessed by all sections of users. Most of such websites are hosted outside the country.
The filtering of websites with obscene/objectionable content poses a technical challenge. These websites keep on changing the names, domain addresses and hosting platforms from time to time making it difficult to filter or block such websites using technical tools available in the market. In addition, the tools provide filtering to a limited extent only. The tools, in the process, also filter genuine content and degrade the performance of systems.
The Information Technology Act 2000 amended by the Information Technology (Amendment) Act 2008 with effect from 27.10.2009 together with the Indian Penal Code 1860, provides legal framework for countering websites with obscene/objectionable content including child pornography. Sections 67, 67A and 67B of the Information Technology Act provides stringent punishment and fine for publishing or transmission of pornography in electronic form as well as hosting on website any information which is lascivious, or contains sexually explicit act or conduct, or depicts children engaged in sexually explicit act. Section 67 provides imprisonment upto three years and fine upto five lakh rupees for first conviction and imprisonment upto five years and fine upto ten lakh rupees for subsequent convictions. Section 67A and Section 67B provides punishment upto five years and fine upto ten lakh rupees for first conviction and imprisonment upto seven years and fine upto ten lakh rupees for subsequent convictions.
This information was given by Shri Sachin Pilot, the Minister of State for Communications and Information Technology in written reply to a question in Lok Sabha today.

Central Government Employee gets post-retirement benefits at age of 91
The Delhi High Court on Tuesday directed the central government to provide its 91-year-old former employee some of the post-retirement benefits that he had been unable to avail due to lack of information.
Justice S Muralidhar ordered the government to provide former Indian Railways employee KSR Chari the benefits of railway pension and family pension scheme that he had been unable to avail due to a communication gap.
The court was hearing Mr Chari's petition in which he alleged that he had been unable to avail the benefits of the scheme due to lack of proper communication by his first employer State Railway Coal department, which he joined in 1942, to his second employer the National Coal Development Corp (NCDC).
"In conclusion, this court would like to take judicial notice of the fact that with rising inflation and spiralling prices of basic commodities, the life of the elderly in our country is becoming increasingly difficult," the court said.
With every passing day they feel the pinch of rising prices whether it is food, provisions, transport or health care, it said.
The court said the provident fund amount that some of the retired employees got after many years of dedicated service, was meagre by today's rates of income. Moreover, the rates of return on the lump sum amounts had drastically reduced over the years.
"The elderly cannot risk investing their precious savings in the volatile and uncertain share market. Had some of them opted for pension, they would have a better level of sustenance. It is not surprising then that those who gave the best of their productive lives for the progress of the country and the betterment of our lives justifiably feel that they are being treated unfairly and that the Government owes them more," said the court in its 12-page order.
"The lives of the elderly in our country are becoming increasingly difficult. For a majority of retired government servants, the social security cover, if it can be called that, is palpably inadequate to ensure them a decent living," said the court, ordering the government to provide Chari the two post-retirement benefits for railway employees.
The court imposed a fine of Rs. 5,000 each on the coal and mines ministry and NCDC for objecting to Chari's plea that he had come to the court after a gap of several decades after retirement.
