OFFICE MEMORANDUM

Sub: Surrender of general pool residential accommodation.

Reference is invited to the Directorate of Estates OM of even number dated 5.9.5005 which provides guidelines for surrender of general pool residential accommodation. The instructions on the subject mentioned above have been reviewed.

2. As per the provisions of SR 317-B-14, an officer may at any time surrender the general pool residential accommodation in his occupation by giving intimation to the Directorate of Estates at least two days before the date of vacation of the residence. The allotment of the residence shall be deemed to have been cancelled with effect from the eleventh day after the day on which the letter is received by the Directorate of Estates or the date specified in the letter whichever is later. If he fails to give due notice he shall be responsible for payment of licence fee for ten days or the number of days by which the notice given by him falls short of ten days, provided that the Director of Estates may accept a notice for a short period.

3. However, there are certain following events for which surrender notice to surrender general pool residential accommodation is not required to be submitted to the Directorate of Estates:

(a) When an officer is in occupation of a lower type residence than his entitlement is allotted a residence of type to which he/she is entitled.

(b) When an officer on his re-employment is found to be entitled to a lower type of residence and as per provisions of SR 317-B-11(4) is allotted a residence in that type.

(c) When an officer is given a change of residence to another residence in the same type either under (i) SR 317-B-15, or (ii) SR 317-B-16, or (iii) SR 317-B-17, or (iv) SR 317-B-21.

(d) When the residence in occupation of an officer is required to be vacated for a public purpose, repairs or demolition and the officer is allotted alternative accommodation.

(e) When the officer does not accept the residence allotted in (b), (c)(iv) and (d) above and he chooses to surrender his existing residence.

(f) When the allotment of the residence in occupation of an officer is cancelled/deemed to be cancelled under the provisions of the Allotment Rules.

(g) When the son/daughter, etc of the retiring/deceased allottee officer gets alternative accommodation on ad hoc basis.

(h) The allottee, who is permitted concessional retention of the accommodation under SR 317-B-11 ad SR 317-B-22 after the cancellation of allotment.

4. This issues in supersession of O.M.No.12035/16/2005-Pol.II dated 5.9.5005 and with the approval of the competent authority.

Subject : Recovery of licence fee under FR-B with and without Departmental Charges and the Special Licence Fee in respect of General Pool Accommodation including Hostel accommodation in Delhi.

The flat rates of licence fee in respect of Central Government Residential Accommodations have been revised w.e.f.01.07.2010. It has been decided to revise the pooled unit rates of licence fee under FR-45-B with and without Department Charges (D.C) and the Special Licence Fee in respect of General Pool accommodation including Hostel Accommodation in Delhi. Subject : Revision of flat rates of Licence fee for Central Govt Residential Accommodation throughout the country.

In terms of SR-324(4), the Government has decided to revise the flat rates of licence fee recoverable for the residential accommodation available in General Pool and also in Departmental Pools of Ministries & Departments of the Government of India throughout the country (except in respect of substandard/unclassified accommodation of Ministry of Defence, accommodation for service personnel of the Ministry of Defence and accommodation under the control of Ministry of Railways), as shown in the Annexure.


2. The revised rates of licence fee would be effective from 1st July, 2010. All Ministries / Departments are requested to take action to recover the revised licence fee in accordance with these orders in respect of accommodation under their control all over the country.

3. This issues with the concurrence of integrated Finance Wing of the Ministry of Urban Development under its Diary No. 545/Dir. (F)/FD/10 dated 15.11.2010 & dated 03.01.2011.

4. In so far as persons serving in the Indian Audit & Accounts Departments are concerned, orders would be issued separately.

Directorate of Estates takes various initiatives to streamline government accommodation


Directorate of Estates in the Ministry of Urban Development has been mandated the job of providing official residential accommodation to officers working in eligible offices. With a view to augment availability of residential accommodation of higher types, the following pro-active initiative have been taken by Directorate Estates over the last one year.

The Government is conscious of the acute shortage of residential accommodation to its officers in Delhi. Towards this, New Moti Bagh Residential project has been completed under PPP mode by NBCC. This has provided much relief to the senior officers of the Government. The Government is in advance stage of considering and approving another PPP project for re-development of East Kidwai Nagar. In the East Kidwai Nagar, it is proposed to develop another 4747 units of Government residential accommodation, with majority of accommodation in lower types i.e. Tye-IV and below. In addition to this, the Government is also constructing houses on the DDU Marg.

It was seen that on many occasions the officials who were allotted flats were not vacating houses on transfer/retirement. This was further adding to the scarcity in allotting flats to the eligible officials. The Ministry of Urban Development (Directorate of Estates) is taking action to ensure eviction of unauthorized occupants from Government flats/houses. During the calendar year 2011, 815 unauthorized occupants were evicted.

During the period from January to December, 2011, a total of 520 allotments were cancelled on account of subletting against 306 cancellations in the year 2010. The cancellation of allotment is being pursued to ensure vacation of the house. Already 350 houses have been got vacated till December, 2011.

During the period January to December, 2011, an amount of about Rs.4.70 crores have been recovered on account of damages i.e. penal rent on account of unauthorized occupation. It is mentioned that earlier, while sending notices for recovery of outstanding dues, a notice was also sent to the family members of late Smt. Indrani Devi showing an outstanding dues of Rs.1.98 crores. On further examination of documents, it has been established that House No.6. Krishna Menon Marg was vacated on 30.11.2002 by the family members of late Smt. Indrani Devi and, therefore, the demand notice for Rs.1.98 crores has been withdrawn.

Introduction of Automated System of Allotment in respect of type-I category w.e.f. 01 .01.2012

Subject : Introduction of Automated System of Allotment in respect of type-I category w.e.f. 01 .01.2012.
The undersigned is directed to invite attention to this Directorate’s O.M. of even number dated 22.12.2010 introducing Automated System of Allotment (ASA) in respect of houses of the lower types i.e. Type-II to Type-IV. It has since been decided to introduce Automated System in respect of Type-I category also w.e.f. 01.01.2012 as per following schedule:
1. With effect from 01.01.2012 only online applications for allotment of Type-I houses will be accepted. After applying online, the applicants will be required to take a print out of the application form and forward to the Directorate of Estates after getting the same verified from their Department / Office. No manual application will be accepted from 01.01.2012.
2. The applicants applying online whose applications are received up to 15.01.2012 will be eligible for participation in the ASA system and shall be able to exercise options during the period 16th to 27th of each month. The first allotment through fully automated mode in Type-I will take place on 28.01.2012. Allotments in subsequent months in respect of Type-I will take place on the 28th of every month.
3. Every applicant will be required to furnish his/her mobile number and e-mail ID to enable this Directorate to send their login ID and password through SMS/e-mail.
4. The practice of reconsideration and technical acceptance will be stopped with the introduction of ASA system. The applicants who fail to accept the allotment made as per their choice, shall be debarred for further allotment for a period of one year.
5. Detailed procedure as laid down in the O.M. dated 22.12.2010, available on the website of this Directorate i.e. www.estates.nic.in shall be applicable.
6. A help desk has been established in the IFC of the Directorate of Estates near Gate No. 2, Nirmari Bhawan, New Delhi. Application may seek help form the help desk, if required.

Subject: Introduction of Automated System of Allotment in lower types of Govt. houses.
With a view to introduce complete transparency, speedy allotment, higher occupancy of houses and enable the applicants to get houses of their choice, it has been decided to introduce the Automated System of allotment in lower type as already introduced earlier in the higher types.
In this system, list of all vacant houses and also the waiting list is placed on the website of this Directorate and the applicants are required to give their option of one or more houses of their choice in order of priority keeping in view their seniority as per procedure mentioned herein under:-
With effect from the date as mentioned in para 2 below, all applicants for allotment of houses will be accepted “online” only.
Every applicant will have to create his/her account by filling up the required on line application form following the instructions on the screen. After completing the process, on line, the applicant will have to take a print out of his/her application and submit to the Directorate of Estates a self signed copy thereof for activation of his/her account. On receipt of the application, his/her account will be activated by sending a Registration Number (which will work as his/her ID) and a pass word through SMS and/or e-mail. For this purpose every applicant whether new or already registered has to furnish his mobile No. and Email ID.
Once the applicant has received his/her registration number and log-in-pass-word through SMS/e-mail, then he/she will be able to operate his/her account for giving option for house/houses and also making required changes in his/her preferences, choices etc.
Both existing applications as well as new applicants will have to indicate their choices/preferences for houses online.
All the applications received up to 15th of the month will be included in the waiting list. Also all houses falling vacant till 15th of each month would be displayed, pool-wise, on this Directorate’s website (estates.nic.in) for giving choices by the applicants during 16th to 1st for Type-II each month. During this period, the list of vacant houses as well as the waiting list will remain frozen. Regular allotments will be made each month on 25th for type-III and 2nd for Type-II.
(vi). An applicant will be allotted the house chosen by his/her if nobody senior to him/her in the waiting list has opted for the some.
(vii) The concept of technical acceptance will be done away with.
(viii). Applicants will be eligible for one change in each category of house. No separate change waiting list will be prepared. Waiting list for change as well as the first allotment will be the same. On the day of enforcement of the Automated System of Allotment the existing change waiting list (Which is based on first come-first- serve principle) will be frozen and will be placed, en block, senior to the unified waiting list prepared as per the new order.
(ix). With effect from the date as indicated in para 2 below for each type the present practice of maintaining a separate-change waiting list on first-come-first serve —principle and area/locality wise waiting list will be done away with.
(x). The applicants will have to necessarily accept the house allotted as per their choice. In the event of non-acceptance, the applicant will be debarred for further allotment for a period of one year.
2. Subject to such modifications as may be notified from time to time, allotment of General Pool Residential Accommodation through automated system would come into force with effect from date Indicated below
