All the three Defence Federations will go on Indefinite Strike from 17-2-2014In a meeting held on 28-1-2014, all the three recognised Defence federations AIDEF, INDWF and BPMS have decided to go on Indefinite strike from 17-2-2014. INDWF informed in its blog about the decision taken by three federations on indefinite Strike on Charter of Demands to be settled.

Dear Colleagues,
Three Recognised Defence Federations (INDWF, AIDEF & BPMS) have jointly decided and issued a Joint Declaration on 19.09.2013 to call for a Joint Agitation by the Defence Civilian Employees including of a indefinite strike. Notice of the Joint Declaration was sent to Defence Secretary Dt. 19.09.2013 alongwith the charter demands. The Joint Declaration and the programme of action together with the charter of demands was sent to all our affiliated unions for conducting Strike Ballot. Accordingly strike ballot was conducted by our affiliated unions as per our programme on 19.12.2013 and reports were sent to the Federation HQrs. It has been observed as per reports that more than 98% of the Defence Civilian Employees all over the country have voted in favour of the indefinite strike as the demands are very much genuine and long pending.
After receiving the reports of the strike ballot, we have sent further intimation to the secretary, Ministry of Defence that the majority employees have supported the strike and the Ministry of Defence should settle the problems forth with failing which, the Defence Civilian Employees will go on indefinite strike and the date for strike will be intimated.
Three recognized Federation have met at New Delhi on 27.01.2014 and noted with serious concern that even after more than 4 month after forwarding the Joint Declaration alongwith charter of demands, there is no progress in settlement of the issues pertaining to Defence Civilian Employees and the Govt. has not taken any step forward for a negotiated settlement/Agreement on the charter of demands.
Considering the negative attitude of the Government and Ministry of Defence towards the demands of the Defence Civilian Employees and its negligence, three Federations have decided in the meeting held on 27.01.2014 at New Delhi to organize Defence Civilian Employees for an indefinite strike starting from 17.02.2014 from 0600 AM in support of the following charter of demands. The meeting also calls upon the affiliated unions of the three Federations to jointly mobilize the Defence Workers by various agitational programmes during the period of serving strike notice on 03.07.2014 and make the strike a grand success.
The meeting also appeals to the CDRA, its affiliates and all other trade unions and associations functioning in the Defence Establishments to join the indefinite strike in the interest of unity of the Defence Employees and also realize the out standing demands of the Defence Civilian Employees.

CHARTER OF DEMANDS
Demands on Service Matters :-
1) Grant of 2nd / 3rd MACP in Grade Pay Rs. 4600/- to the Artisan Staff of Defence Establishments who were granted 2nd ACP in the Chargeman Pay Scale of Rs. 5000-8000 upto 31.12.2005 (inspite of MoD’s recommendation matter is pending with Defence Finance)
2) Correlation of the hourly rate of Industrial Workers deployed on Piece Work system in Ordnance Factories in 6th CPC Pay Scale w.e.f. 01.01.2006 (inspite of MoD’s recommendation matter is pending with Defence Finance)
3) Grant of Departmental Overtime Wages to the Industrial Workers deployed on Piece Work system in the Ordnance Factories (inspite of MoD’s recommendation matter is pending with Defence Finance)
4) Grant of hourly rate to the Piece Workers of Ordnance Factories who were given MACP benefits, (inspite of MoD’s recommendation matter is pending with Defence Finance)
5) Grant of revised ACP benefits to the labourers who have completed 30 years of service by granting an one time exemption of Trade Test. (MoD’s recommendation in the matter is pending with DOP&T)
6) Grant of revised ACP benefits to the erstwhile Group “D” NIEs (MoD’s recommendation in the matter is pending with DOP&T)
7) Revision of Night Duty Allowance w.e.f. 01.01.1996 and from 01.01.2006 in the 5th and 6th CPC rates respectively by implementing the Court Judgments on the subject.
8) Doubling of the Risk Allowance for Defence Civilian Employees w.e.f, 01.09.2008 has agreed in the National Anomaly Committee Meeting.
9) Implementation of the following judgment to the similarly placed employees. As per the provisions of DOP&T OM No. A11019/2/98-AT dated 03rd September, 1998
i) Grant of MACP in promotional hierarchy (Government’s SLP dismissed in the case of CAT Chandigarh Bench Judgment on OA No. 1038/CH of 2010)- ii) Placement from HS Grade to HS Grade-I should be ignored for . granting MACP (Judgment of CAT Principal Bench New Delhi in the case of Employees of 505 ABW, New Delhi referring various Supreme Court Judgments) iii) Restoration of the opportunity of Chowkidars and Safaiwalas of MES for redesignation as Mate (SS) (Judgment of the Hon’ble CAT Ernakulam Bench in OA No.109/2012 dated 12.12.2012) iv) Removal of discrimination and grant of skilled pay scale of Rs. 260-4000/950-1500 to non-petitioner Valvemen of MES (Judgment of Hon’ble CAT Jodhpur Bench in OA No. 51/2002 dated 21st July, 2003) v) Inclusion of HRA and Transport Allowance etc. for computation of OT Wages under Factories Act 1948 based on the judgment of Madras High Court, vi) Implementation of higher Pay Scale and grade structure for the similarly placed Cooks of all Defence Establishments as granted to the Cooks of Air Force vide MoD Letter No. Air HQ./23064/Cooks/PC-4/444-CC/D (Air-!II) dated 12th November, 2013 based on the judgment of Hon’ble Principal Bench CAT, New Delhi. 10) Approval of all cadre review proposals of MTS, Durwan, Fireman, Drivers, Storekeeping Staff, Industrial Canteen Staff, Para Medical Staff, Stenographers, DEO, JJWM and Clerical Staff of OFB, DRDO, DGQA, Navy, EME, AOC, Air Force and other Directorates pending at different level.
11) Grant of PRIS to the DRDO Employees at par with Department of Atomic Energy and ISRO.
12) Revision of Fixed Medical Allowance to the Defence Employees posted at hard stations / isolated places and also grant of medical reimbursement for inpatient treatment for such employees by implementing the judgment of Punjab and Haryana High Court.
13) Grant of Four Grade Structure to the Ammunition Mechanic of NAD under Navy.
14) Grant of Four Grade Structure to the Meter Reader of MES at par with
the Artisan Staff,
15) Extension of CSD Canteen facilities for retired defence civilian employees at par with Ex-Serviceman.
16) Revision of Bonus Payment ceiling and Gratuity Ceiling limit.
17) Opening of CGHS Dispensaries in all major cities and recognition of Hospitals under CGHS in Hill Stations.
DEMANDS ON POLICY ISSUES
1) Withdraw DPP-2013 which is against the interest of DRDO and Ordnance Factories.
2) No FDI in Defence Sector.
3) No disturbance in the functioning of DRDO by implementing Professor Rama Rao Committee recommendations.
4) No arbitrary reduction of manpower in the various Army Units in the name of ASEC Report in violation of the Cabinet Secretary’s directions.
5) No closure of any Defence Units including Military Farms,
6) Stop all types of outsourcing / contract and regularize all the existing contract/casual workers.
7) Fillup all the posts lying vacant in all the Defence Establishments.
8) Withdraw the New Pension Scheme.”
9) Grant of Compassionate Appointment 100% as being granted by the Railway Ministry.
10) No reduction of sanctioned strength of the Ordnance Factories based on Sourab Kumar Committee Report. DEMANDS ON TRADE UNIONS RIGHTS AND FUNCTIONING OF JCM
1) Regular meeting with the recognized Federations by the MoD and other Directorates should be ensured.
2) Three meetings of the Departmental Council (JCM) and four meeting of the JCM-III Level Council as per the constitution of the JCM Scheme should be ensured.
3) Grant of Trade Unions rights to all the non gazetted employees working. in the Defence Establishments as being given in the case of Railway.
4) Grant of Trade Unions rights to the Employees of Hospitals and Training Establishments under MoD since these Establishments are already recognized as Industry by the Labour Ministry.
5. Grant of Trade Unions rights to the Defence Civilian Employees postedat area declared under SRO-17E.
DEMANDS ON 7th CPC ISSUES
1) Settle all the 6th CPC Anomalies and all Cadre review proposals before 7th CPC starts functioning.
2) Accept all the terms of reference of 7th CPC submitted by the staff side of National Council (JCM) to the DOP&T.
3) Implement the revised comprehensive pay packet for the Central Government Employees as on 01.01.2014.
4) To Consider the demand of merger of Dearness Allowance/Dearness Relief with Basic Pay and Basic Pension and also grant of interim relief.
The 4 lakhs Defence Civilian Employees who are the fourth force of the Defence of our country are committed and dedicated workforce and they work side by side with the uniformed personnel for the security of our great natioi. Their contribution to the Defence preparedness cannot be underestimated. Any disturbance in the industrial relations in the Defence Estatlishments will hamper the Defence preparedness. The Defence Civilian Employees and their Trade Unions with this responsibility in mind were patiently waiting for settlement of their demands. However, since there is no positive outcome inspite of our best efforts, the Defence Civilian Employees are forced to proceed with an indefinite Strike from 17.02.2014

This has the reference to your office letter 127/PM/G II/C-266 dated 17.07.2013 on the subject cited above.
2. In this context, I am directed to convey that GIO (1) below FR 26 provides that where a person has been selected for regular appointment and before formally taking over the charge of the post for which selected person is required to undergo training, training period undergone by such a Government servant whether on remuneration or otherwise counts as duty for the purpose of drawing increments. This order is applicable only in case of direct recruits. Further Rule 10 of CCS (RP) Rules, 2008 provides that employees completing six months and above in the Revised pay strucutre as on 01st Jul will be eligible to be granted the increment. Thus, from the contents of GIO (1) below FR 26 read with Rule 10 of CCS (RP) Rules, 2008, it is clear that "a Government servant who has completed the six month service including training period (whether on remuneration or otherwise) as on 01st Jul will be eligible for increment." This is applicable only in case of direct recruits.

It’s The Temple Run by the Students Oakridge School
Students of 8th grade at Oakridge School make pride their school by placing the handy-cam made movie ‘Temple Run’ for screening in the 18th International Children Film Festival.
Speaking to the media here on Friday, that “Temple Run” is an adventurous movie shot with a handi-cam with whatever resources they had on hand. Flanked by the little directors of the film, their guide Ramesh and Adi Lakshmi, and the principal of their school expressed happy that the number of students are coming forward to take up similar projects.
“It is a unique experience and we are so delighted. What began as a project work could finally ended making it to a prestigious forum like the ICFFI,” said the little directors who worked for the project when they were in the Seventh Standard.
It was all an in-house product as shooting, editing and other technical work was done on the school campus, said Principal Adi Lakshmi. Guide Ramesh wanted more encouragement for making children films.

It has now been decided that for offices in Delhi / New Delhi, the Holiday on the occasion of Muharram will now be on Friday, the 15th November, 2013 and all Central Government Administrative offices located in Delhi / New Delhi shall remain closed on account of Muharram on 15th November, 2013.

CIRCULAR
The instances have come to the notice, where employees apply for LTC and proceed without sanction of LTC as well as the leave. It has also been noticed in some of the cases that the Divisional Head (Leave Sanctioning Authority) has only recommended the leave which does not mean the leave is granted. For proceeding on LTC it is informed to all that without grant of leave and sanction of LTC an employee cannot proceed on LTC. The Member Secretary, Central Board has viewed it very seriously and following instructions are issued for information and for strict compliance by all the employees;
(a) Without issue of LTC order as well as leave sanction order an employee shall not proceed for LTC.
(b) Even if, LTC is not applied, an employee shall not leave their Head Quarter without sanction of the leave order.
(c) The employees are advised that they should well plan their LTC programme before applying for the same and the leave must be granted by the concerned Divisional Heads/ Incharge Zonal Offices.
(d) The intended place of visit (other than declared home town) should be well decided before applying the LTC.
(e) Once the LTC is sanctioned, only genuine request beyond the control of the employee, for preponement/postponement or cancellation whatsoever will be considered by the Competent Authority.
(f) Employee must enquire the correct fare per ticket of their entitled class from Railways or Airlines for the intended place of visit, before applying for LTC.
(g) When no advance is taken, the LTC claim should be submitted within three months from the completion of return journey. Otherwise, the claim will be forfeited.
(h) When advance is taken, the claim should be submitted within one month from the date of return journey. If not, the outstanding advance will be recovered in one lumpsum and the claim will be treated as one where no advance is sanctioned. Further, panel interest @ 2% over & above of CPF interest on the entire advance from the date of drawal to the date of recovery will be charged.
(i) When claim submitted within stipulated time but unutilized portion of advance not refunded, interest is chargeable on that amount from the date of drawl to the date of recovery.
(j) When a part of the advance becomes excess drawl due to genuine reasons beyond the control of the employees, the Competent Authority, if satisfied, exempt charging of interest.
This issues with the approval of the Competent Authority, Central Pollution Control Board.

Prithvi Does it Again
A missile unit of the elite Strategic Forces Command (SFC) successfully launched the second consecutive Prithvi missile today from the test range nearChandipur, off the Odisha Coast as part of a scenario based live salvo launch training exercise. Like the launch on 7th October 2013, this launch too was flawless and achieved all its targeting and technical parameters set out for the training exercise.
In the words of an SFC spokesperson ‘Both the launches were conducted as a culmination to a strategic training exercise. The aim of this exercise to war game our readiness to undertake launches in various contingencies under varied conditions, thereby was validated.
Prithvi missiles are indigenously produced and are equipped with improved high accuracy navigation and manoeuvring system. Inducted into India’s Strategic Forces Command in 2003, the Prithvi II missile, the first missile to be developed under India’s prestigious IGMDP strengthens India’s nuclear deterrence.

Holiday for Vijay Dashmi – Dussehra on 14.10.2013
Based upon the request of COC Karnataka. The Confederation CHQ has taken up the case of declaring holiday on 14.10.2013 of Dussehra (Vijaya Dashami) instead of 13/10/13, DOPT has expressed the view that this is a national holiday and it should be applicable to the entire nation. Secretary General of Confederation was in constant touch with DOPT officials in this matter and has explained to DOPT officials the importance of Dussehra (Vijaya Dashami). DOPT gives its opinion on leave case that this holiday issue is for entire nation not just of Karnataka State, no other state committee has given such request. Hence DOPT has indicated that it cannot change the holiday from 13/10/13 to 14/10/13. However still efforts are going on from COC side, but we cannot assure any person on the possibility.

Subject:- Productivity Linked Bonus for the Accounting year 2012-2013. Sir/Madam, I am directed to convey the approval of the President of India for payment of Productivity Linked Bonus for the accounting year 2012-2013 equivalent of emoluments of 60 (Sixty) days to the employees of Department of Posts in Group `D`,Group `C` and non Gazetted Group `B`. Ex-gratia payment of Bonus to Gramin Dak Sevaks who are regularly appointed after observing all appointment formalities and adhoc payment of Bonus to Casual labourers who have been conferred Temporary Status are also to be paid equivalent to allowance/wages respectively for 60 (sixty) Days for the same period. 1.1 The calculation for the purpose of payment of Bonus under each category will be done as indicated below. 2. REGULAR EMPLOYEES: 2.1 Bonus will be calculated on the basis of the following formula:- Average emoluments X Number of days of Bonus ------------------------------ 30.4(Average no. of days in a month) 2.2 The term “Emoluments” for regular Employees include basic Pay in the pay Band plus Grade Pay, Dearness Pay, Personal Pay, Special Pay (Allowances), S.B.Allowance, Deputation (Duty ) Allowance, Dearness Allowance and Training Allowance given to Faculty Members in Training Institutes. In case of drawl of salary exceeding Rs.3500/- (Rs. Three Thousand Five hundred only)in any month during the accounting year 2012-13 the Emoluments shall be restricted to Rs.3500/- (Rs. Three Thousand Five hundred only) per month only. 2.3 “ Average Emoluments” for regular Employees is arrived at by dividing by twelve ,the total salary drawn during the year 2012-13 for the period from 1.4.2012 to 31.3.2013, by restricting each month’s salary to Rs.3500/- (Rs. Three Thousand Five hundred only) per month. However, for the periods of EOL and dies-non in a given month ,proportionate deduction is required to be made from the ceiling limit of Rs.3500/- (Rs. Three Thousand Five hundred only). 2.4 In case of those regular employees who were under suspension, or on whom dies-non was imposed ,or both, during the accounting year, the clarificatory order issued vide Paras 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt-I) dated 11.6.81 and No. 26-4/87-PAP (Pt.II) dated 8.2.88 will apply. 2.5 Those employees who resigned, retired, left service or proceeded on deputation within the Department of Posts or those who have proceeded on deputation outside the Department of Posts on or after 1.4.2012 will also be entitled to Bonus. In case of all such employees, the Bonus admissible will be as per provisions of Para 2.1 to 2.3 above. 3. GRAMIN DAK SEVAKS (GDS) 3.1 In respect of Gramin Dak Sevaks who were on duty through out the year during 2012-2013, Average monthly Time Related Continuity Allowance will be calculated taking into account the Time Related Continuity Allowance (TRCA) plus corresponding Dearness Allowance drawn by them for the period from 1.4.2012 to 31.3.2013 divided by 12 (Twelve). However, where the Time Related Continuity Allowance exceeds Rs 3500/- (Rs.Three Thousand Five hundred only) in any month during this period., the allowances will be restricted to Rs 3500/- (Rs.Three Thousand Five hundred only) per month. Ex-gratia payment of Bonus may be calculated by applying the Bonus formula as mentioned below:- Average TRCA X Number of days of Bonus ------------------------------ 30.4 (Average no. of days in a month) 3.2 The allowances drawn by a substitute will not be counted towards Bonus calculation for either the substitute or the incumbent Gramin Dak Sevaks. In respect of those Gramin Dak Sevaks who were appointed in short term vacancies in Postman/Group `D` Cadre, the clarificatory orders issued vide Directorate letter No. 26-6/89-PAP dated 6.2.1990 and No. 26-7/90-PAP dated 4.7.91 will apply. 3.3 If a Gramin Dak Sevak has been on duty for a part of the year by way of a fresh appointment, or for having been put off duty, or for having left service, he will be paid proportionate ex-gratia Bonus calculated by applying the procedure prescribed in Para 3.1 3.4 Those Gramin Dak Sevaks who have resigned, discharged or left service on or after 1.4.2012 will also be entitled to proportionate ex-gratia Bonus. In case of all such Gramin Dak Sevaks, the Ex-gratia Bonus admissible will be as per provisions of Para 3.1 above. 3.5 In case of those Gramin Dak Sevaks who were under put off duty or on whom dies non was imposed, or both during the accounting year ,the clarificatory orders issued vide Para 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt I) dated 11.6.81 and No. 26-4/87-PAP (Pt II) will apply. 4. FULL TIME CASUAL LABOURERS INCLUDING TEMPORARY STATUS CASUAL LABOURERS) Full Time Casual Labourers (including Temporary Status Casual Labourers ) who worked for 8 hours a day, for at least 240 days in a year for three consecutive years or more (206 days in each year for three years or more in case of offices observing 5 days a week) as on 31.3.2013 will be paid ad-hoc Bonus on notional monthly wages of Rs.1200/- (Rupees Twelve Hundred only) The maximum ad-hoc Bonus will be calculated as below:- (Notional monthly wages of Rs.1200) X (Number of days of Bonus) ------------------------------ 30.4 (average no. of days in a month) Accordingly , the rate of Bonus per day will work out as indicated below:- Maximum ad-hoc Bonus for the year ------------------------------ 365 The above rate of Bonus per day may be applied to the number of days for which the services of such casual labourers had been utilized during the period from 1.4.2012 to 31.3.2013. In case where the actual wages in any month fall below during the period 1.4.2012 to 31.3.2013 the actual monthly wages drawn should be taken into account to arrive at the actual ad-hoc Bonus due in such cases. 5. The amount of Bonus /Ex gratia payment /Adhoc Bonus payable under this order will be rounded to the nearest rupee. The payment of Productivity Linked Bonus as well as the ex-gratia payment and ad-hoc payment will be chargeable to the Head `Salaries` under the relevant Sub –Head of account to which the pay and allowances of the staff are debited. The payment will be met from the sanctioned grant for the year 2013-2014. 6. After payment, the total expenditure incurred and the number of employees paid may be ascertained from all units by Circles and consolidated figures be intimated to the Budget Section of the Department of Posts. The Budget Section will furnish consolidated information to PAP Section about the total amount of Bonus paid and the total number of employees (category-wise) to whom it was distributed for the Department as a whole. 7. Orders have been issued vide this Ministry’s Office Memorandum No.7/24/2007 E-1I1(A) dated 27th September, 2013 authorizing 30 days. emoluments as Non-PLB (Ad-hoc bonus) for the accounting year 2012-13 to the eligible Central Government employees not covered by the Productivity Linked Bonus Schemes, subject to terms and conditions laid down therein.
2. The undersigned is directed to say that it has now been decided that the Non-PLB (Ad-hoc) bonus so admissible subject to the terms and conditions laid down in the aforesaid orders, may be extended to the employees of autonomous bodies, partly or fully funded by the Central Government which (i) follow the pattern of pay structure and emoluments identical to that of the Central Govern-ment and (ii) do not have any bonus or ex-gratia or incentive scheme in operation.
3. In case of doubt as to the operation of these orders the clarificatory orders, circulated vide this Ministry’s O.M. No.14(10)E-Coord/88 dated 4.10.88, as amended from time to time, may be kept in view, mutatis mutandis
4. Any request for funding by the Government to meet the liability on account of Non-PLB (Ad-hoc bonus) in respect of various autonomous organizations would not be considered by the administrative Ministries concerned, having regard to the stipulation of aforesaid O.M. dated 27th September, 2013 that the expenditure on Non-PLB (Ad-hoc bonus) should be met from within the existing budgetary provisions of the respective organizations. While the Autonomous Bodies not funded by the Central Government may also adopt these orders as per their own administrative and financial judgment in respect of their employees, no liability for funding will, in any case, lie on the Central Government on this account.
