Women central government employees who have filed complaints of sexual harassment can now get a paid leave of three months during the pendency of inquiry, the government has said.
The leave will be in addition to those already given to central government employees.
The move assumes significance as there have been complaints of accused trying to influence or threaten victims of sexual harassment in a few cases.
Leave up to a maximum of 90 days may be granted to an aggrieved female government servant during the pendency of inquiry, an order issued by Department of Personnel and Training (DoPT) said.
"The leave so granted to the aggrieved woman under this rule shall not be debited against the leave account," it said.
This provision has been framed under the 'Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013--a legislation mandated to provide protection to women against sexual harassment at work place.
Though the Act has the provision for grant of leave to the aggrieved woman up to a period of three months, the Union government had not yet incorporated it in the service rules that govern leave of its employees. The DoPT has now incorporated this provision in the Central Civil Services (leave) Rules, 1972.
"It will come as a relief to the victims who undergo a lot of trauma while working in the office that too in the presence of the accused," a senior DoPT official said.
Sexual harassment includes physical contact and advances, demand or request for sexual favours, sexually coloured remarks, showing any pornography and any other unwelcome physical, verbal and non-verbal conduct of a sexual nature.
Besides, implied or explicit promise of preferential or detrimental treatment in employment; implied or explicit threat about her present or future employment status; interference with her work, creating an intimidating, offensive or hostile work environment for her; and humiliating treatment likely to affect her health or safety may also amount to sexual harassment.

In order to encourage the women to join Government service, they are provided some special facilities as maternity leave, child care leave, child adoption leave, special allowance to women with disability, provision of crèche facility, posting of husband and wife at the same station, special priority in allotment of residential accommodation, provision for protection of women from acts of sexual harassment, age relaxation for appointment to widows, divorced woman and woman judicially separated from their husbands and who are not remarried, special dispensation for woman officers of All India Services of North East cadre, change of Cadre in case of marriage of All India Service Officer and exemption from payment of fee for examinations conducted by the Union Public Service Commission and Staff Selection Commission.
As per the recommendations of the 62nd Department Related Parliamentary Standing Committee, publicity to encourage women to prefer/join Government Service is being given. There is a provision for age relaxation for appointment in Government service for Widows, divorced Women and Women judicially separated from husbands and not re-married upto 35 years for posts of Group C filled through Staff Selection Commission/Employment Exchange (upto 40 years for members of Scheduled Castes/Scheduled Tribes).
Minister of State in the Ministry of Personnel, Public Grievances and Pensions Dr. Jitendra Singh gave this information in Rajya Sabha today in a written reply to a question by Shri T.K. Rangarajan and Shrimati Gundu Sudharani.

Cash Assistance to Pregnant and Lactating Women
The Government of India in the Ministry of Women & Child Development is implementing a centrally sponsored scheme namely, Indira Gandhi Matritva Sahyog Yojana (IGMSY), Conditional Maternity Benefit (CMB) for pregnant and lactating (P & L) women to improve their health & nutrition status to better enabling environment by providing cash incentives to pregnant and nursing mothers. It is being implemented using the platform of ICDS.
The scheme was introduced in October, 2010 on pilot basis now operational in 53 selected districts. The scheme attempts to partly compensate for wage loss to Pregnant & Lactating women both prior to and after delivery of the child. The scheme envisages providing cash directly to the beneficiary through their Bank Accounts/Post Office Accounts, in response to individual fulfilling specific conditions. The scheme covers all pregnant and lactating women above 19 years of age and above for first two live births except Government/PSUs (Central & State).
The Government is conducting an independent evaluation of the scheme in the current financial year 2012-13 to assess the performance of the scheme in the States/UTs. The steps to extend the scheme in all the districts throughout the country will be undertaken on the basis of the results of the evaluation.
This was stated by Smt. Krishna Tirath, Minister for Women and Child Development, in a written reply to the Rajya Sabha today.

On the occasion of the International Women`s Day today, the Union Minister of Communications & IT Sh. Kapil Sibal inaugurated India`s First All Women Employees Post Office at Shastri Bhawan, here today. This office is a Project Arrow Office and has three counters. Two counters offer Multi Purpose services like booking of Speed Post, Registration, Sale of IPOs, Booking of Money Orders etc. and one counter is for Sale of Stamps. All these counters of this Post Office will now be manned by Women employees only. The working hours of this Post Office will be from 9.30 a.m. till 5.30 p.m. There are 1003 women employees at the operative level in Delhi circle and their percentage in the total work force is about 14%. In the administrative cadres the percentage is 22%. In a co-incidence the Junior Engineer [Civil] who is Incharge of maintenance of this Post Office building, the Assistant Superintendent of Post Offices of the Postal Sub Division as well as Senior Superintendent of Post Offices of Delhi Central division who are controlling officers of this Post Office are also women. Love Your Parents - A Touching Story
After 12 years of marriage, my wife wanted me to invite another woman to dinner and a movie. She told me: “I love you, but I know that the other woman loves you and would like to spend time with you.” The Other Woman , which my wife asked to pay attention to, was my mother. She was a widow for over 19 years. But since my job and three children demanded all my strength from me, I could only visit her occasionally. That evening I called her to invite her to dinner and a movie. - What happened ? Are you okay? – she asked me at once. My mother’s first reaction was usually like this whenever she the phone rang late at night she reckoned it was bad news. - I thought it would be nice to spend some time with you: – I answered. She thought for a moment, then said: ‘I really want this.” On Friday after work I went for it and i was a little nervous. As my car pulled up outside her house, I saw her standing at the door and noticed that she seemed a little too excited. She stood in the doorway of the house, threw her coat over her shoulders. Her hair was curled in ringlets, and she was in the dress she had bought to celebrate the recent anniversary of my wedding. - I told my friends that my son will take me to the restaurant today evening, and they were deeply impressed – she said , sitting in the car. We went to a restaurant. Though it was not luxurious, but it was very nice and cozy. My mother took my arm and walked as if she was my first lady. When we sat down at a table, I had to read her the menu. My mother’s eyes are now able to distinguish only large fonts. As i finished reading half of it, I looked up and saw that my mother was sitting, staring at me, and a nostalgic smile lay on her lips. - In the past, when you were little, I read the whole menu for you – she said. - So, it is time to pay a favor – I replied. During dinner, we had a very good conversation. It was nothing special. We simply shared the latest events in our lives. But we got so busy that we were late for the film. When I left her home, she said: ‘Once again, I’ll go with you to the restaurant. Only this time, I invite you. ” I agreed. - How was your evening? – My wife asked when I got home. - Very good. Much better than I imagined – I replied. A few days later my mother died of a massive heart attack. It happened so suddenly that I had no chance to do something for her. A few days later I received an envelope with a payment receipt from the restaurant where we had dinner with my mother. The receipt had an attached note: “I paid the bill for our second dinner in advance. However, I’m not sure I could have dinner with you. But nevertheless, I paid for two people. For you and your wife. I have no words to explain to you what that dinner to which you invited me, meant to me: My son, I love you. Take care of your parents! They are the only ones who truly rejoice in your successes and experience for your failures. As a woman, you are entitled
to some rights by law that protect you when you have been violated. Here are
some that you should be aware of.
RIGHT TO PRIVACY WHILE
RECORDING STATEMENT
Under section 164 of the
Criminal Procedure Code, a woman who has been raped can record her statement
before the district
magistrate when the case is under trial, and no one else needs to be present.
Alternatively, she can record the statement with only one police officer and
woman constable in a convenient place that is not crowded and does not provide
any possibility of the statement being overheard by a fourth person. The police
have to, by law, protect the woman’s right to privacy. It’s important for the
person to feel comfortable and not be under any kind of stress while narrating
the incident.
TIME DOESN’T MATTER
The police cannot refuse to
register an FIR even if a considerable period of time has elapsed since the
incident of rape or
molestation took place. If
the police tells you that they can’t lodge your FIR since you didn’t report it
earlier, do not concede. “Rape is a horrifying incident for any woman, so it’s
natural for her to go into shock and not want to report it immediately. She may
also fear for her safety and the reputation and dignity of her family. For this
reason, the Supreme Court has ruled that the police must register an FIR even
if there has been a gap between the report and the occurrence of the incident,”
says Tariq Abeed, advocate, Supreme Court.
POLICE CAN’T SAY NO
A rape victim can register
her police complaint from any police station under the Zero FIR ruling by
Supreme Court. “Sometimes,
the police station under
which the incident occurs refuses to register the victim’s complaint in order
to keep clear of responsibility, and tries sending the victim to another police
station. In such cases, she has the right to lodge an FIR at any police station
in the city under the Zero FIR ruling. The senior officer will then direct the
SHO of the police station concerned to lodge the FIR,” says Abeed. This is a
Supreme Court ruling that not many women are aware of, so don’t let the SHO of
a police station send you away saying it “doesn’t come under his area”.
NO ARRESTS AFTER SUNSET
According to a Supreme Court
ruling, a woman cannot be arrested after sunset and before sunrise. There are
many cases of women
being harassed by the police
in the wee hours, but all this can be avoided if you exercise the right of
being present in the police station only during daytime. “Even if there is a
woman constable accompanying the officers, the police can’t arrest a woman at
night. In case the woman has committed a serious crime, the police has to get
it in writing from the magistrate explaining why the arrest is necessary
during the night,” says
Bhaumik.
YOU CAN’T BE CALLED TO THE
POLICE STATION
Women cannot be called to the
police station for interrogation under Section 160 of the Criminal Procedure
Code. This law
provides Indian women the
right of not being physically present at the police station for interrogation.
“The police can interrogate a
woman at her residence in the
presence of a woman constable and family members or friends,” says Abeed. So
the next time you’re
called to the police station
for queries or interrogation when you have faced any kind of harassment, quote
this guideline of the Supreme Court to exercise your right and remind the cops
about it.
THE DOCTOR CAN’T DECIDE
Acase of rape can’t be
dismissed even if the doctor says rape had not taken place. A victim of rape
needs to be medically examined as per Section 164 A of the Criminal Procedure
Code, and only the report can act as proof. “A woman has the right to have a
copy of the medical report from the doctor. Rape is a crime, not a medical
condition. It is a legal term and not a diagnosis to be made by the medical officer
treating the victim. The only statement that can be made by the medical officer
is that there is evidence of recent sexual activity. Whether the rape has
occurred or not is a legal conclusion and the doctor can’t decide on this,”
explains Bhaumik.
PROTECT YOUR IDENTITY
Under no circumstances can
the identity of a rape victim be revealed. Neither the police nor media can
make known the
name of the victim in public.
Section 228-A of the Indian Penal Code makes the disclosure of a victim’s
identity a punishable offense.
Printing or publishing the
name or any matter which may make known the identity of a woman against whom an
offense has been committed is punishable. This is done to prevent social
victimisation or ostracism of the victim of a sexual offense. Even while a
judgment is in progress at the high court or a lower court, the name of the
victim is not indicated, she is only described as ‘victim’ in
the judgment.
EMPLOYERS MUST PROTECT
It is the duty of every
employer to create a Sexual Harassment Complaints Committee within the
organisation for redressal of such complaints. According to a guideline issued
by the Supreme Court, it is mandatory for all firms, public and private, to set
up these committees to resolve matters of sexual harassment. It is also
necessary that the committee be headed by a woman and include 50 per cent women
as members. Also, one of the members should be from a women’s welfare group.

India’s first Mobile Application for Women Safety
Tech Mahindra had long back developed an application called FightBack which was being used only by the staff members of Mahindra Group.
After the gang-rape of a woman in New Delhi, Mahindra’s has now thrown open this smart phone application for public use, beyond Mahindra employees.
The FightBack application tracks a user’s location and sends SOS messages to selected contacts in case of an emergency.
This application is now available for download on the company website for free & IS ONLY FOR INDIAN MOBILE NUMBERS.
The FightBack app allows the user to press on a panic button whenever he/she feels unsafe.
It tracks the location using GPS and alerts chosen contacts about the location map and is available on Android and Blackberry.

Delhi Rape, Capital Punishment and Punishment at Capital City

For several weeks now, I have been trying to spend more time doing things and less time watching things happen or reading about events ----so there is far less of television, but even with very limited viewing, I could not turn away from the disgusting spectacle of young men and women being lathi charged and water canoned on Raisina Hill. Any one with even half a heart, any one with a family,any one with a daughter or sister or wife or mother or girl friend will empathize with the anguish and anger and helplessness that the thousands pouring out at India Gate and Raisina Hill are giving voice to.
Law and order is no more than the name of a television serial to some of us, and a rather pathetic joke to everyone else.None of us feels safe on the roads of NCR, not women, not men,not teenagers, not senior citizens. The feeling of insecurity cuts across class and community. No one is safe. Period.
So when a particularly brutal act of aggression takes place and a young girl shows the enormous courage to survive it,does the government express contrition at its dismal record of upholding citizen security and admiration at the amazing spirit of a young Indian? No. Instead, it pats the Delhi Police on the back.
Does it reach out to the young men and women who are voicing the concern of each one of us ? Does it speak in a voice that seeks to reassure? No. It lathi charges them instead and clamps section 144 over the entire city. Are we living in a democracy, or are this country's rulers slowly beginning to emulate the Chinese?
Would the need for a lathi charge have arisen if the President or the Prime Minister or the Home Minister had stepped out of his citadel, begged forgiveness of the crowd gathered at Raisina Hill, and promised prompt action? Was there a threat of violence to the person of these worthy representatives of our democracy? If there wasn't, was it merely misplaced arrogance that prevented a dialogue? We already see the sorry spectacle every year of the Prime Minister addressing the nation from behind a bullet proof glass at Red Fort. Is every other public building and public funtionary going to be similarly fortified?
Where was the young brigade, Rahul Gandhi, Sachin Pilot, Jyotiraditya Scindia, Jayant Chaudhary, Deepinder Hooda? Could none of them have stepped forward and bravely faced the crowd gathered at Raisina Hill? Or do they only pontificate from the safe confines of the Parliament, or public stages barricaded by gun toting commandos?
More than the corruption scams of the past few years, these acts of callousness reinforce the belief that what this country needs is a revolution in thinking,a new paradigm, a fresh approach to nation building. The current systems stink.

Following is the text of Additional Statement by Union Home
Minister Shri Sushilkumar Shinde in Parliament today on the Gang Rape incident
in South Delhi:-
“This is in continuation to my earlier Statement made in both the Houses on 18.12.2012 wherein I had committed that I will take a detailed review with Delhi Police officers and Home Secretary along with officers of Home Ministry. 2. Of the six accused, four have been arrested already and Police Teams are continuously undertaking raids to arrest the remaining two. A Special Investigation Team under the DCP has been constituted to monitor investigation closely. The FIR No. 413 dated 17.12.2012 under Section 365/376(2)(G)/377/394/34 IPC was registered at Police Station Vasant Vihar wherein subsequently Section 307 and 201 have also been added. Apart from the above, a Police Team with one lady IPS officer has been directed to visit the Hospital at regular intervals to take stock of the medical condition of the victim on regular basis and to liaise with the parents of the victim. 3. I also reviewed the aspect which resulted in the heinous crime being conducted in the moving bus. As a result of the review with the Police Officers and Transport Commissioner, it has been decided that :- (i) There shall be an immediate crackdown on all buses/commercial vehicles having tinted glasses and curtains and all such vehicles be impounded immediately. (ii) All commercial vehicles/buses shall be directed to keep their lights on during the night while plying on the roads of Delhi. (iii) All off duty buses must be parked with the owner and not with the driver/staff. (iv) All those commercial vehicles/buses found violating the contract carriage conditions or any other permit condition, shall be impounded and their permits be cancelled. (v) The Delhi Police shall undertake verification of all drivers/staff of all public vehicles. All such buses/autos which are being plied by unverified staff/drivers shall be impounded. (vi) Driver’s Licence and all details along with photo shall be compulsorily displayed in all public vehicles along with a help line No. on which complaint can be lodged. 4. Apart from the above, it has also been decided to augment the PCR fleet of Delhi Police by providing more number of vehicles and the same would be GPS enabled so that their movement can be tracked at the Central Control Room”. |
