We all know very well that one of the important and unresolved pleas of ex-servicemen for a long time has been the One Rank One Pension (OROP).

We cannot compare other central government employees with army personnel who do a noble job of protecting our mother nation. Some people work in a dangerous environment. For others their work itself can be extremely dangerous. Our Army personnel come under the second category. The natural topography in which they work is very rough, extremely snowy and rainy with deadly shells fired anytime from the tanks of the enemies. Our Army constantly endures all these dangers.

Our army men risk their live and work in order to help us live peacefully. So they have be given the highest regard and honoured by us all. It is the crucial service of our army that helps us in times of natural calamities like unforeseen earthquakes, floods, landslides and hazardous times like riots. It can never be the right thing to make such noble people plead for their rights or provoke them to protest just to get their fair demands fulfilled.

The Employees’ Federation and Industry Associations of various departments of the Central Government have to announce their open support for the One Rank and One Pension (OROP) demand of Ex-servicemen. We have to exert pressure on the Central government and force them to make a suitable Government Order in this regard at the earliest possible. 

Through this, we can attract the attention of the 7th Central Pay Commission which is going to be implemented from 1/1/2016 and certainly influence its secretive stand related to pension related matters to the maximum extent possible.

10th Wage Agreement

Indian Banks Association inked wage settlement with Employee Unions and Officers’ Associations today, 25th May, 2015. The settlement gives 15% increase in salary and Allowances to about 10 lakh bank employees.

Employees and officers from 43 banks including public sector banks, old private sector banks and some of the foreign banks benefit from the wage revision. The current wage revision is effective from 1st November 2012 and will be valid for 5 years. In all 11 All India Employees Unions and Officers’ Associations participated in the wage revision exercise.

The scale pay of Officers has been revised from Rs.14500 - Rs.52000 to Rs.23700 - Rs.85000. (Special allowance for officers ranging from 7.75% to 11% of basic pay along with applicable Dearness allowance has also been introduced)

The scale pay of Workmen - non-subordinate has been revised from Rs.7200-Rs.19300 to Rs.11765-Rs.31540, also the scale pay of Subordinate staff has been revised from Rs.5850-Rs.11350 to Rs.9560-Rs.18545. (Special allowance for workmen @7.75% of basic pay along with applicable Dearness allowance has also been introduced)

Another important feature of the settlement is that a medical insurance scheme is being introduced for families of employees.

The 15% wage revision would cost the Public Sector banks Rs.4725 crores as incremental Salary and allowances in a year. Banks have been making provision for wage revision from November 2012. Mr. T M Bhasin, Chairman, IBA and Mr. Rajiv Rishi, Chairman, Negotiating Committee of IBA led the Management team in the negotiations. IBA expects banks will implement the revision immediately.

IBA expects the salary revision to improve the moral of the bank employees, leading to better productivity.

PSU bank employees will soon get pay hike, arrears for 30 months

 Mumbai, May 22:  Employees of public sector banks, old generation private sector banks and some foreign banks will be a happy lot as they will soon get 15 per cent pay hike, arrears for the last 30 months, and other benefits as part of a deal that the unions and bank managements have reached.

Unions, under the aegis of the United Forum of Bank Unions, and bank managements, represented by the Indian Banks’ Association, have worked out a detailed Bipartite Settlement/ Joint Note and the same will be formalised on May 25.

The benefits that about 7.50 lakh bank employees stand to get are a special pay, a new hospitalisation scheme backed up by insurance and holiday on every second and fourth Saturday in a month.

The back wages (arrears) that bank employees will get for the last 30 months will warm the cockles of their heart. Income tax authorities too will be happy as arrears will be taxable.

S Nagarajan, General Secretary, All India Bank Officers’ Association, said “A special allowance has been introduced for employees… there is a new hospitalisation scheme backed up by insurance.” The wage settlement will benefit 3,04,000 odd officers (as on March 31, 2012) in the banking sector.

Officers will get health insurance cover of Rs. 4 lakh and the clerical and sub-staff will get Rs. 3 lakh cover, he added.

A corporate buffer will be created by banks to reimburse hospitalisation expenditure exceeding the abovementioned limits.

Pointing out that the last wage settlement expired in October 2012, Nagarajan, in a lighter vein, observed that “Five years is the tenure of the wage settlement. We have already exhausted 30 months in coming to a settlement. It’s time now to submit the next charter of demands.”

Vishwas Utagi, Vice President, All India Bank Employees Association, said the wage settlement will benefit about 4.50 lakh clerical and sub-staff in the banking sector.

Bank employees will get close a couple of lakh rupees, on an average, as arrears in gross terms, he explained. Since payrolls are computerised, the arrears could be credited to employees’ accounts in a month.

Utagi said the issue of upgradation of pension of retirees and 100 per cent neutralisation of dearness allowance will be taken up by the United Forum of Bank Unions separately.

The undersigned is directed to say that this Department receives a number of references from Government servants/ various Ministries/Departments seeking clarifications regarding the eligibility of Government employees in respect of Home Town LTC. The point of doubts raised and their clarifications are as under :-

An enemy’s enemy is always a good friend in politics. But what happens when the enemy’s enemy turns out to be a friend’s bete noire? Does he still remain a friend or turns into a liability?
In the wake of J Jayalalithaa’s acquittal by the Karnataka High Court, the BJP and its senior leader Subramanian Swamy may find themselves in an awkward situation. Their relationship status may be getting slightly complicated.
The BJP, it is evident, is happy that the former (and future) Tamil Nadu chief minister has emerged as ‘tested pure gold’ out of the disproportionate assets case. The PM has already congratulated her. The BJP floor managers are seeing in her acquittal the beginning of a beautiful friendship in the Parliament, where AIDMK members can help the government on crucial issues.
But Swamy, the original complainant in the DA case, isn’t happy. “It's not an unusual thing. When you are in a democratic system, then such twists and turns are expected. We can't do much about it because delays are done by the accused. She has now earned the right to be sworn as the chief minister again,” Swamy said after the HC verdict.
Swamy has hinted that he isn’t giving up and may approach the Supreme Court. “If this is lost, then there is an appeal. She lost in the sessions court and went for an appeal. Now let us see what happens in the further appeal,” he said.
In all likelihood, since it is keen on running with the AIDMK in the Parliament, the BJP will not allow Swamy to hound Jayalalithaa. After the verdict, the usually pugnacious Swamy was unusually subdued, giving rise to speculation that he had been asked to hold his fire on the Jayalalithaa issue.

But Swamy has always been a bit of a loose cannon. The problem with such quick-gun politicians is that you never know when they would start firing in the wrong direction, or at their own camp. Lutyen’s insiders believe the troika of Ram Jethmalani, Arun Shourie and Swamy has turned against Modi. And while the first two have already fired their ammo, Swamy could be next.
“Known for his provocative statements in praise and criticism, Swamy had last year said Modi had 'Brahminical gunas' in response to Opposition attack on his brand of politics. Less than a year later, he started questioning his government on its approach towards bringing back black money, the Rafale deal and the black money Bill. Swamy, who last year in an interview had said that being a member of the BJP he cannot file a PIL against the government, recently threatened to challenge the Prime Minister's commitment to buy the French combat aircraft,” according to a report in DNA.
Swamy has, however, changed his mind on the Rafale deal, ostensibly because the government acted on his advice. “The government has immediately responded to what I have said. The old deal as envisaged is being scrapped. It was a deal between Sonia Gandhi and Nicolas Sarkozy (then President of France). No country was buying the old Rafale aircraft, as the radar was old and the fuel consumption too high. I have met the Defence Minister, Manohar Parrikar, and the old deal has been closed. The bribe taken in this regard may have to be returned by the Indian wrongdoers. In the new situation, India will buy 36 aircraft, which will be built in France. It will have a new radar. It will take two years for India to acquire the modern aircraft. There is no corruption now. There will be no PIL from my end. My work is done,” Swamy told a gathering recently.
Swamy’s plea on the black money issue is listed for hearing in the Supreme Court today. The Modi government has already steered the Black Money bill through the Lok Sabha. It would be interesting to see if Swamy does a Rafale on black money, claiming victory out of political necessity.
Giving up his crusade against Jayalalithaa won’t be an easy political compromise for Swamy. He has pursued the case for almost two decades now. His credibility would be depend on whether he appeals against the HC verdict or forgets his animosity for the political benefit of his new friends.
The choices for Swami are limited. Since he was a one-man party before he joined the BJP, he didn’t bring much to the table in terms of votebank or cadre. His real assets, perhaps, were his Hindutva ideology, interest in economy (it led the Swamy Army to believe he could be Modi’s finance minister), the reputation of a gossip-monger –his private ‘investigations’ in the Sunanda Pushkar, innuendoes on Priyanka and Rahul Gandhi are classic examples of the use of rumours and canards in political warfare-- and a fearless fighter of big battles against powerful politicians, some of
whom happened to be his own and the BJP’s common enemies.
But the game is changing. The BJP is now keen to turn old foes into friends. If Swamy continue to fight his private wars, he would soon find out that his best friends are now his worst enemies.

Various inputs were received that provisions of Foreign Contribution (Regulation) Act, 2010 are being violated by Greenpeace India Society, Chennai, Tamil Nadu. Standard questionnaire was served to the association. After receipt of reply to the standard questionnaire, as there were prima-facie violations of FCRA, 2010, an on-site inspection of accounts and records of the Greenpeace India Society, Chennai, Tamil Nadu was conducted by the Ministry of Home Affairs from 24th to 27th September, 2014. 

During the course of the inspection the following violations were noticed:- 

a) Transferred Foreign contribution to other than FCRA designated bank accounts in violation of Section 17 of FCRA, 2010.

b) Under reported and repeatedly mentioned incorrect amount of Foreign Contribution received in violation of Section 33 of FCRA, 2010 

c) Incurring more than of 50% of the Foreign Contribution on administrative expenditure in violation of section 8(1)(b) of FCRA, 2010. 

d) Replacement of 50% or more of the executive committee members without obtaining prior approval of Ministry of Home Affairs which is a violation of the undertaking & declaration given by the association in its application for registration under Rule 9(1)(a) of FCR Rules, 2011. 

e) Foreign NGO funding legal costs not only of bail, but also of writ petitions etc. of Indian NGO’s and their activists’, thereby violating Section 8(1)(a) of FCRA, 2010 

f) Shifting of office and activities from Chennai, Tamil Nadu to Bengaluru, Karnataka without approval/intimation of the Ministry of Home Affairs, violation of Rule 9(1)(a) of FCR Rules, 2011. 

g) Transferred foreign contribution to a non-FCRA registered NGO by payment of salary of its employees which amounts to violation of Section 7 of FCRA, 2010. 

h) Suppressed and not disclosed payment of salary by foreign NGO to a foreign activists who worked on secondment which is a violation of Section 33 of FCRA, 2010. 

The above violations were communicated to the association for their comments. After receipt of the comments from the association, the matter was examined in the Ministry and subsequently, the registration granted to the association under Foreign Contribution (Regulation) Act, 2010 has been suspended on 09th April, 2015 for 180 days and a show cause notice was issued to the association as to why its registration should not be cancelled. Simultaneously, seven bank accounts of Greenpeace India Society which were found to be involved in transacting foreign contribution have been frozen to prevent further transactions. 

This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in a written reply to a question by Shri Paul Manoj Pandian in the Rajya Sabha today (13.05.2015)

I am directed to say that considering the suggestions of circle offices regarding issue related to increase/revise the monetary ceiling of financial limits of expenditure/reimbursement of expenditure on purchase of brlef-cases/ ladies purses for official purpose by the eligible/entitled officers, it has been decided by the competent authority to increase/revise the financial limits for reimbursement as under:-

The periodicity of such briefcases/ladies purses should not exceed for 3 years’ time in any case.
The declaration should be obtained from the eligible/entitled officer at the time of reimbursement that no Brief Case/Ladies Purse has been supplied/reimbursed to him/her within the last three years.
The above ceiling is effective from the date of Issue of this order.

4. The expenditure in this connection will be met by the Circle/Region/Divlsion and Unit concerned.

With due regards, your attention is invited to Section 6. of the Payment of Wages Act, 1936 which stipulates that all wages shall be paid in current coins or currency notes or in both provided that the employer may after obtaining the written authorisation of the employed person, pay him the wage, either by cheque or by crediting the wages in his bank account.

It is worth to mention here that the Head of Departments / Head of Offices of the defence installations under Army, Air Force, Navy, DDP, DRDO etc. have successfully convinced all the industrial & non-industrial civilian employees to draw their wages in bank account and has got the salary account opened in nationalized bank including State Bank of India,

Further, State Bank of India grants some privileges/facilities to the holders of salary accounts under Defence Salary Package, which are mentioned in annexure of this letter. But it is painful to note that the same benefit is not being extended to civilian employees of the same defence installation.

Therefore, you are requested to take necessary action so that the industrial / non-industrial civilian employees of defence installations may also get the benefits of Salary Accounts under Defence Salary Package.

The undersigned is directed to invite attention to this Ministry’s OM No.19(3)/2013/D(Lab) dated 18.11.2014 vide which all administrative/authorities were requested to strictly comply the instructions contained in Para 8 of DoP&T OM No. 14014/02/2012-Estt(D) dated 16.1.2013 regarding withdrawal of three years time limit and Sl.No. 38-43 of FAQ issued vide DoP&T OM No. 14014/02/2012-Estt(D) dated 30.5.2013.

2. An issue has been raised by Bhartiya Pratiraksha Mazdoor Sangh (BPMS) informing that the Line Directorates/Units of Army HQrs are not considering the compassionate appointment cases in true spirit of the guidelines issued by DoP&T and the requests for compassionate appointment are being rejected on the plea that as per policy once three consecutive chances had been considered, the Case is considered to be closed and cannot be opened.

3. As per the new guidelines on compassionate appointment, any application for compassionate appointment is to be considered without any time limit and decision taken on merit in each case.

4. Regarding re-opening of old cases which were closed on completion of three years time limit as per the earlier policy of DoP&T, it may be noted that the DoP&T vide their OM dated 30.5.2013 have clarified that the closed cases can be reopened provided tat the cases were closed due to non-availability of vacancies during the 3 year time period. However these cases may be considered as per the criteria mentioned in Sl.No. 32 & 39 of FAQ dated 30.5.2013. Such cases should not be opened merely because the time limit has been waived off. In this regard DoP&T have further clarified that the cases which have been closed for not being found suitable under the criteria for compassionate appointments, need not to be opened irrespective of the waiver of time limit.

5. In view of the above, all the Service HQrs / lower formations are requested to follow the DoP&T’s above guidelines in letter and spirit. They may not reject any application for compassionate appointment simply on the ground that it had already been considered thrice unless it was rejected due to lack of merit/not found suitable under the criteria for compassionate appointments. If the compassionate appointment could not be granted due to non-availability of vacancies at that time, any fresh application, received now should be re-considered after adjudging his penurious condition on the basis of the family’s latest financial/economic condition, number of dependents of the family as on date, latest marital status of dependents etc in the light of the existing guidelines of DoP&T on the subject.
