Ministry of Labour & Employment EPF ContributionThe following steps have been taken by the Employees’ Provident Fund Organisation to recover the outstanding amount: 1. Attachment and sale of movable and immovable properties of the defaulting establishments. 2. Appointment of receiver to run the business of the defaulting establishments. 3. Arrest and detention of defaulter. 4. Prosecution of defaulters before courts of law. 5. Levying damages as penalty. 6. Directing persons from whom any amount is due to the defaulter to pay the same amount against Provident Fund arrear instead of paying to the defaulter. The details are given at Annexure. There is no provision of confiscating the property of defaulters under the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952. However, 84 arrests were made and 2,842 convictions were ordered by various courts during the last three years. This information was given by the Minister of Labour and Employment Shri Mallikarjun Kharge in reply in reply to a written question in the Lok Sabha today. |
