Eradication of Untouchability

Article 17 of the Constitution of India has abolished the practice of untouchability; its practice in any form is forbidden and is an offence punishable in accordance with law. An Act of Parliament, namely, the Protection of Civil Rights Act, 1955, prescribes punishment for the enforcement of any disability arising from preaching and practice of untouchability. As per the data provided by the National Crime Records Bureau, Ministry of Home Affairs, during 2011, 74 cases were registered by the police under the PCR Act.

The said Act is implemented by the concerned State Governments and Union Territory Administrations. With a view to ensure effective implementation of provisions of the Act, Central assistance is provided to States/Union Territories, which includes strengthening of the enforcement machinery, incentive for inter caste marriages and awareness generation. They are requested to implement provisions of the Act in letter and spirit.

The Central Government has been addressing the States/UTs to implement provisions of the PCR Act in letter and spirit.

A Committee under the Chairpersonship of Union Minster for Social Justice & Empowerment which was constituted in the year 2006, also inter-alia reviews implementation of the PCR Act in State/UTs. The Committee has so far held twenty meetings wherein implementation of the said Act in 24 States and 4 Union Territories has been reviewed.

This information was given by the Minister of State for Social Justice and Empowerment, Shri P. Balram Naik in a written reply to a question in Lok Sabha today.

Union government is aware that cyber-crime is becoming a major threat to national security and armed forces are bracing to cope with the challenge. Usage of pen drive on Internet computers has been banned as a policy due to inherent security threat posed by pen drives.

Computers and communication systems in Ministry of Defence are procured from recognized Original Equipment Manufacturers (OEMs)/Companies as per the procurement procedures of the Government.

A Cyber Security Policy 2008 issued by the Ministry of Defence is under implementation, which inter-alia, includes continuous awareness campaign, audit of networks, strengthening of cyber security activities and maintaining of air gaps. Cyber security issues are also coordinated by National Security Council Secretariat (NSCS) at the national level.

Subject : Allotment of Grade Pay of Rs. 5400/- in PB-2 for Group 'B' Gazetted Officers and Grade Pay of Rs.4800/- in PB-2 to Supervisors in the Railways.

The undersigned is directed to refer to Ministry of Railways OM No.PC VI/2008/IC/21 dated 06.01.2012 and DO letter No.PC-VI/2008/IC/20 dated 06.03.2012 on the subject mentioned above. The matter has been reconsidered in this department and as regards allotment of Grade Pay of Rs.5400/- in PB-2 for Group 'B' Gazetted Officers who were in the pre-revised scale of Rs.7500-12000, It is observed that Group 'B' Gazetted Officers in the pay scale of Rs.7500-12000 exists in all the Ministries / Departments also and agreeing to the instant proposal would have wide repercussion. In view of the above, this department’s earlier decision dated 11.08.2010 is re-iterated. Consequently the proposal for allotment of Grade Pay of Rs. 4800/- in PB-2 to Supervisors who were in the pre-revised scale of Rs.6500-10500 & Rs.7450-11500 is also not agreed to.

How IDA increase is calculated?


How IDA increase is calculated?

We have been reporting the increase in IDA every three months, always before official announcement is made.

We have not been making predictions or assumptions. Our reporting has always been based on standard calculation used for the purpose. We feel that the members also should be aware of the calculation. Hence this article.

The IDA rate revision is based on All India Consumer Price Index. After Second Pay Revision w.e.f. 1.1.2007, the base index has also been revised to 1.1.2007, which is 126.33



For arriving at IDA increase we need to know the All India Consumer Price Index for Industrial Workers [CPI(IW)] for the previous three months. For IDA revision w.e.f. 1st July of a year, the CPI of March, April and May are required. For IDA revision w.e.f.1st October, CPI of June, July and August are required and so on.

The average CPI of the three months is then taken for calculation and the following formula is used:

New IDA rate = (Average CPI – Base Index) x 100 / Base Index

Increase in IDA rate = New IDA rate – Old IDA rate
Example:
CPI for
June 2009 - 153
July 2009 - 160
August 2009 - 162

Average: 158.33
Calculation: 158.33 – 126.33 x 100
-------------------------- = 25.3
126.33
IDA rate w.e.f. 1.7.2009 was 18.5

Therefore Increase in IDA rate w.e.f.1.10.2009 was = 25.3-18.5 = 6.8

CPI for a month is notified on the last day of the next month in Labour Bureau Website at http://labourbureau.nic.in/indnum.htm. This information is also published in ‘The Hindu’ on the first day of every month in Business column.

That’s all. It is so simple. Now, any one can on his own calculate the IDA rate increase w.e.f. 1.4.2010, on 31st March 2010 itself. Those who don’t want to take that little effort can login to http://www.aibsnloa.org/related/idacalculation.xls and just fill in the CPI for February 2010 and get the magic figure of Increase in IDA rate w.e.f.1.4.2010.

The undersigned is directed to say that this office has received a complaint through Secretary (Coord & PG), Cabinet Secretariat, Rashtrapati Bhawan, New Delhi regarding refusal of issue of NSC in the name of Grand Daughter (minor) to one Sh.S.P.Jain by Palam Vihar PO as well as SSPOs gurgaon (Haryana).

2. It is clarified that as per Rule 4(2)a of NSC-VIII issue and IX issue rules, a single holder type certificates may be issued to an adult for himselh or on behalf of a minor or to a minor. Therefore, it is clarified that NSCs can be purchased by any adult in the name of a minor irrespective of any relation.

3. It is requested that all this may be circulated to all Post Offices for information and necessary guidance so that complaints of this nature may be avoided.

4. This issues with the approval of DDG(FS).

Our Constitution has Stood the test of Time as it has Ensured Peaceful
Reconstruction and National Renewal, Cooperative Federalism and inclusive Development- Dr. Ashwani Kumar
The Law & Justice Minister Addresses The Law Day Function
Stating that the Constitution of India has stood the test of time, Dr. Ashwani Kumar, Minister of Law and Justice, has said that it has ensured peaceful reconstruction and national renewal, cooperative federalism and inclusive development. Addressing the Law Day function here today as the Guest of Honour, Dr. Kumar said that the Constitution of India has served as an “auxiliary precaution” against transient impulses, and has moderated the political discourse consistent with the non negotiable constitutional imperatives. Inaugurated by the Chief Justice of India, the function was organized by the Supreme Court Bar Association.

Following is the text of the Law and Justice Minister’s address at the Law Day function: “This is indeed, a special day in the life of our nation. This day, 63 years ago the people of India gave unto themselves their national charter to establish a sovereign, socialist, secular and democratic republic and a promise to ensure for all Indian citizens justice, liberty, equality and fraternity.

This is an occasion to offer tribute and pay our humble obeisance to the framers the Constitution who took nearly three years to give us this magnificent document, hailed as amongst the finest constitutions in the world. It draws on the models provided by the constitutions of the US, Canada, Australia, the Irish Free State, the British constitution and the Government of India Act 1935, and draws its legal authority from the Indian Independence Act of 1947. The Indian Independence Act was itself a result of the protracted struggle for India’s freedom. During the Indian Freedom movement, the Indian National Congress had pledged to provide guarantees for fundamental rights which remain the sheet anchor of our national charter.

Our Constitution has stood the test of time. It has ensured peaceful reconstruction and national renewal, cooperative federalism and inclusive development. It has served as an “auxiliary precaution” against transient impulses, and has moderated the political discourse consistent with the non negotiable constitutional imperatives.

It has subserved the twin objectives of a government limited by laws and committed to constitutionalisation. As a nation, we can be justly proud of our abiding commitment to the rule of law, free elections, fundamental rights of the people, directive principles of state policy, federalism, and decentralization of power as the bedrock of constitutional governance.

The task of ensuring that our republican charter remains a “living Constitution” stands entrusted to superior judiciary, more particularly to the Supreme Court. The great judges of this Court have not shirked from shifting their attention from word play to the facts of life. Through a balancing of pretending constitutional absolutes, the court has preserved the fine constitutional balance within which the three organs of the state are required to work. Our constitutional jurisprudence built on the edifice of path breaking judgments of this Court have enriched the functioning of democracy in action.

The Landmark judgments of the apex Court have indeed clothed the skeleton of the basic Law. I can recall path breaking judgments of the Court in - D.S. Nakara , Royappa, Dayanand Shetty, Indra Sawhney, S.R. Bommai , Kesavananda Bharati , Minerva Mills, Waman Rao , Bachchan Singh , Maneka Gandhi , I.R. Coelha , Chameli Singh, Khatri , Mohini Jain, Hussainara Khatun, Bandhua Mukti Morcha and many others all of which have vindicated the conscience of the Constitution.

The promise of the constitution would have remained a dead letter but for the higher judiciary which, as the final arbiter has given content to the spirit of the Constitution and by giving it meaning in “new settings as society changes.” We know that there is no such thing as a constitutional provision with a static meaning. Only when given life by the court can the law “rule”. Indeed, as Judge Cardozo reminded us , and I gook “the outstanding truths of life, the great and unquestioned phenomena of society are not to be argued away as myths and vagaries when they do not fit within our little moulds. If necessary, we must remake the moulds. We must seek a conception of law which realism can accept as true …….”

While arbitrating upon the often competing constitutional imperatives and leaning in favor of the justice of the cause before them, courts have refrained from becoming the third or a revising legislative chamber and the “ Laxman Rekha” in this regard has been drawn by the judges themselves.

The UPA government remains committed to and pledges itself to secure the foundations of the rule of law and judicial independence - integral components of the non-negotiable basic structure of the constitution. The promise of the Constitution in this regard cannot be fulfilled unless we can ensure affordable and speedy justice to all our citizens in larger freedom. A series of initiatives have been taken by the Government towards this in recent times. These include :

a. Establishing a National Mission for Justice Delivery and Legal Reforms

b. Notification of a National Court Management System by the Supreme Court for addressing the issues of case management, court management, setting measureable standards for performance of the courts and the National System of Judicial Statistics in the country

c. A Sub Group on improving the court procedure and court processes for better criminal justice system has been constituted under the Chairman, Law Commission to suggest necessary changes in this regard.

d. An amount of Rs.595 crore was released as central assistance to States / UTs for infrastructure development of subordinate judiciary during 2011-12.

e. The 13th Finance Commission has allocated a grant of Rs.5000 crore for the States over a period of 5 years between 2010-2015 for various initiatives such as increasing the number of court working hours using the existing infrastructure by holding morning / evening / shift courts; enhancing support to LokAdalats to reduce the pressure on regular courts; providing additional funds to State Legal Services Authorities to enable them to provide legal aid to the marginalized and empower them to access justice; and promoting the Alternative Dispute Resolution (ADR) mechanism to resolve some of the disputes outside the court system etc.

In conclusion, let us celebrate our venerated Constitution today and hereafter for not only does its spirit reflect our past, it defines our present and will determine our future as a nation committed to democracy and constitutionalism. We will need to summon our will and intellect to translate into action the promise of the Constitution for the vast multitude of our people to whose welfare our founding fathers were so passionately committed.

The defining moments of history often come without a warning. It is for us to ensure that our “living Constitution” can respond to these moments of history in an age of revolutionary global transformation. Indeed, all national histories, as Gurudev Tagore reminded us are only chapters of a bigger one. At a time when we aspire to play our rightful role on the world stage , India’s ascendancy must represent to the world the vindication of its high Constitutional ideals – the constant expansion of human freedoms, an embrace of diversity and multiculturalism, a repudiation of extremes and an irrevocable commitment to the ideals of a secular and liberal democracy.”

As per available information militants/terrorists active in India are also funded by their outfits based abroad, particularly in Pakistan, often routed through third countries. For the past several years Fake Indian Currency Notes (FICN) has been a well-known source for terror financing in India.

The Government has taken various measures to check terrorist activities in the country such asaugmenting the strength of Central Armed Police Forces, establishment of National Security Guards hubs, strengthening of Multi Agency Centre to function on 24x7 basis for real-¬time collation and sharing of intelligence with other intelligence and security agencies and effective border management. The Unlawful Activities (Prevention) Act, 1967 has been amended to strengthen the punitive measures to combat terrorism. The National Investigation Agency (NIA) has been constituted to investigate and prosecute offences under the NIA Act, 2008. The Prevention of Money Laundering Act has been amended to inter-alia include certain offences under the Unlawful Activities (Prevention) Act.

The Government continues to raise the issues of cross border terrorism including its financing at various multi-level and bilateral fora and also at multi-level and bilateral interactions.

SURPLUS rainwater should be stored underground instead of in dams to prepare for drought, a scientific study says.

The National Centre for Groundwater Research and Training has made the recommendation as the federal government tables Australia's first national Murray-Darling Basin plan in parliament.

Researcher Andrew Ross says Australia should be "banking" its water underground as an alternative to traditional dams during times of heavy rain.

"There is enormous national potential to store surplus water in aquifers, ensuring sufficient water is available for cities, homes, industry, farming and the environment when drought strikes," he said in a statement.

"Historically, Australians have relied on dams to provide water for agriculture and cities.

"This strategy is not sufficient to cope with increasing climate variability or droughts as demand for food and water grows."

Up to 3000 billion litres (GL) of water a year evaporates from the Murray-Darling Basin, he said.

That level of evaporation almost matches the 3200 billion litres a year the government is hoping to flush back into the Murray-Darling Basin, under its plan unveiled last week and tabled in parliament on Monday.

Mr Ross, who has researched integrated surface water and groundwater management, said storing water underground would ensure sufficient was available for Murray-Darling Basin agricultural production and environmental flows, and avoid the shutdown of irrigation.

LTC BENEFITS TO NEWLY RECRUITED CENTRAL GOVERNMENT EMPLOYEES

Leave Travel Concession for Central Government employees in general provides for reimbursement of fare entitled to the employee and his / her family concerned for the travel to home town twice in four years or to a place any where in India in lieu of one home town travel concession once in four years.
As far as newly recruited Central Government Employees are concerned, LTC Scheme provides for some additional benefits which are discussed in this article.

LTC Scheme after implementation of Sixth Pay Commission report – Benefits to Fresh Recruits in the form of additional LTC trips

LTC Rules amended after implementation of sixth pay commission provides certain more Benefits to Fresh Recruits in the form of allowing additional home town trips under LTC (after completion of one year of continuous service in central government service)
As per the amendment made in Rule 8 of LTC Rules, Fresh recruits to Central Government may be are allowed to travel to their home town along with their families on three occasions in a block of four years and to any place in India on the fourth occasion.
This facility shall be available to the Government officers only for the first two blocks of four years applicable after joining the Government for the first time. In other words after completion of one year of continuous service in Central Government service one can avail LTC for three Home town trips and one All India trip in each of two LTC blocks that fall in in the first eight years of Government service
The blocks of 4 years shall apply with reference to the initial date of joining the Government even though the employee changes the job within Government subsequently. The existing blocks will remain the same but the entitlements of the new recruit will be different in the first eight years of service.
After grant of this additional LTC benefits to fresh recruits, doubts were raised whether this additional benefits can be allowed Central Government Employees who have joined in the Government Service prior to 23.09.2008 (i.e. before the date of issue of OM) but yet to complete 8 years of service.
Later, DOPT clarified in this aspect to the effect that all Government servants who have not completed 8 years of service as on 01.09.2008 would be entitled for the LTC benefits available to fresh recruits.

Married and unmarried Central Government Employees can travel to home availing LTC once a year in one block of 4 years:**

This benefit was available even prior to implementation of sixth pay Commission. Under this clause, Married and unmarried Central Government Employees can travel to home availing LTC once a year in one LTC block of 4 years. There is no restriction in the form of number of years of service to avail LTC in this clause. However, this LTC for travel to home town once a year in the block of 4 years restricted to employee only. The family of the employee is not entitled LTC under this clause.
However, following conditions are to be satisfied in order to avail additional Home Town Trips in one LTC block:
1.The family of Central Government Employee should be living away from him/her at her/his home town.
2.No other LTC claim including LTC to all India and home town can be made by the employee for self and his/her family in the LTC block.
(** It is just an assumption that family of fresh recruits would usually be away from him/her at his/her home town. In fact this facility is available all central government employees whose family is at home town. There is no restriction in the form of number of years of service completed)

The Pension Fund Regulatory and Development Authority Bill, 2005 was initially introduced in Lok Sabha in March, 2005 to provide for a statutory PFRDA. However, since the Bill and the official amendments, based on the recommendations of the Standing Committee on Finance, could not be considered by the Lok Sabha, the Bill lapsed on dissolution of the 14th Lok Sabha.

The Government has announced in the Budget 2011-12 that the revised PFRDA Bill would be moved in the Parliament. Accordingly, PFRDA Bill, 2011 was introduced in Lok Sabha on the 24th March, 2011 to provide for a statutory regulatory body the Pension Fund Regulatory and Development Authority (PFRDA) under the provisions of the Bill. The legislation sought to empower PFRDA to regulate the New Pension System (NPS). The PFRDA Bill, 2011 was referred to the Standing Committee on Finance on the 29th March, 2011 for examination and report thereon. The Standing Committee on Finance gave its Report on 30th August, 2011.

The Government decided to accept the recommendations of the Standing Committee on Finance. Based on the recommendations of the Standing Committee, the official amendments to the PFRDA Bill-2011 a proposal to move these additional official amendments in the ensuing session of the Parliament, was approved by the Union Cabinet in its meeting held on 4th October, 2012.

The PFRDA Bill, 2011, inter alia, provides for:
(i) Establishing a statutory Pension Fund Regulatory and Development Authority (PFRDA):
(a) to promote old age income security by establishing, developing and regulating pension funds;
(b) to protect the interests of subscribers to various schemes of pension funds.

(ii) Empowering PFRDA to :
(a) regulate the New Pension System and other pension schemes not covered under any other Act;
(b) register and regulate pension funds and the central recordkeeping agency;
(c) frame investment guidelines for pension funds;
(d) levy monetary penalties for violations of various provisions of the PFRDA Act;
(iii) Imprisonment upto 10 years by courts for contravention of the PFRDA Act, etc. or fine upto Rs. 25 crore or both; and
(iv) Subjecting subordinate legislation to Parliamentary scrutiny.
